What we really need but will probably never get is an honest Supreme Court decision on the constitutionality of the NFA with a focused definition of "shall not be infringed ".

It's a funny old way to get something to the supreme court. The act alone is not specific.

All cases that go to the supreme court are based actions, laws or parts of laws under which someone is "harmed".

Correct, and that is why there has been no successful challenge to the NFA since 1934. Someone with standing must push it through Federal courts all the way to the supreme court. Everyone in America has been harmed by the NFA, but an injured party must take it to court.
It might be possible to do that with very deep pockets. No poor individual could afford to contest it in court.
